Terms and Conditions

These terms and conditions (“Terms”) govern your use of the Website Builder Australia website and the services we provide. By engaging us or using this website, you agree to these Terms.

1. About us

Website Builder Australia (ABN 51 818 742 994) is a Sunshine Coast (Buderim) based web design, development and SEO business. Throughout these Terms, “we”, “us” and “our” refers to Website Builder Australia. “You” and “your” refers to the client or visitor using our services or website.

2. Services

We offer website design, web development, hosting, logo design, search engine optimisation (SEO), online marketing and related services. The exact scope, deliverables, timeline and price for any project will be set out in a written quote or proposal we provide before work begins.

3. Quotes and acceptance

Our quotes are valid for 30 days unless stated otherwise. Work begins once you have accepted the quote in writing (including by email) and any required deposit has been received.

4. Payment

  • Most projects require a deposit before work commences. The deposit amount and balance schedule will be specified in your quote.
  • Invoices are due by the date stated on the invoice.
  • Hosting and ongoing maintenance services are billed in advance (monthly or quarterly as agreed).
  • Late or unpaid invoices may result in services being paused until the account is brought up to date.
  • All prices are in Australian dollars unless stated otherwise. We are not currently registered for GST.

5. Client responsibilities

To deliver your project on time, we rely on you to provide content, images, logos, brand assets, feedback and approvals when reasonably requested. Significant delays in providing requested materials may extend project timelines.

6. Revisions and changes

Each quote includes a defined number of revisions. Additional revisions or changes outside the originally agreed scope may be quoted separately as additional work.

7. Intellectual property

Once a project has been paid for in full, ownership of the final delivered website, logo or other custom artwork passes to you. We retain the right to:

  • Display completed work in our portfolio and on social media unless you ask us in writing not to.
  • Re-use any underlying code libraries, frameworks or generic components that are not specific to your business.

Any third-party content, plugins, themes, stock images or fonts used in a project remain subject to their own licences.

8. Hosting and uptime

Where we provide hosting, we use reputable third-party hosting providers and aim for high availability, but we do not guarantee uninterrupted service. We are not liable for outages caused by upstream providers, internet failures, or events outside our reasonable control.

9. SEO and marketing

SEO is a long-term process and outcomes depend on factors outside our control, including search engine algorithms, competitor activity and the broader market. We will work in good faith and apply industry best practice, but we cannot guarantee specific rankings, traffic levels or conversion rates.

10. Cancellation and refunds

  • You may cancel a project at any time by giving written notice. Work completed up to the date of cancellation, plus any non-refundable third-party costs already incurred, will be invoiced and is payable.
  • Deposits are non-refundable once project work has commenced.
  • Hosting and maintenance subscriptions can be cancelled at any time. Cancellation takes effect at the end of the current billing period; partial-month refunds are not provided.

11. Limitation of liability

To the maximum extent permitted by Australian Consumer Law, our liability for any claim arising out of our services is limited to the amount you have paid us under the relevant project or service, in the 12 months prior to the claim. We are not liable for indirect or consequential loss, including loss of profit, business interruption, or loss of data.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

12. Privacy

Our handling of personal information is set out in our Privacy Policy.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
